YOUR
LEGAL RIGHTS.
1. No Purchase Necessary to Win
No purchase or payment of any kind is necessary to enter or win. ABMP

The winners will be selected by Sponsor in a random drawing on or about
January
4, 2027. The Grand Prize winner will be drawn first from among eligible entrants who confirmed on
the
entry form that they meet the Grand Prize requirements in Section 2. The remaining prizes will then
be
drawn from all remaining eligible entries, in the order listed in Section 5. Each entrant may win
only
one prize. Odds of winning depend on the number of eligible entries received; odds of winning the
Grand
Prize depend on the number of eligible entrants who confirm they meet the Grand Prize requirements.
Forty (40) prizes will be awarded. Winners will be notified via email within seven (7) days after
the
drawing. The Sponsor shall have no liability for a winner's failure to receive notices due to
spam,
junk email, or other security settings or for a winner’s provision of incorrect or otherwise
non-functioning contact information. If a potential winner cannot be contacted, is ineligible, or
fails
to claim the prize within seven (7) days from the time award notification was sent, the prize may be
forfeited and an alternate winner selected. If the Grand Prize winner’s room does not meet the
requirements in Section 2, the Grand Prize may be forfeited and awarded to an alternate winner. To
request a copy of the winners list, send a self-addressed, stamped envelope to the Sponsor at the
address stated at the beginning of these Official Rules. Requests must be received within four (4)
weeks
of the end of the Entry Period.
7. Grand Prize Installation
The Grand Prize installation will take place on a date mutually agreed upon
by
the winner, Sponsor, and The Spa Mart, and must be completed no later than June 30,
2027. Before installation, the Grand Prize winner (and, if applicable, the property
owner)
must sign a separate installation agreement addressing scheduling, access, insurance, and
responsibility
for any damage to the property during installation. IRS Form W-9 must be provided to The Spa
Mart before installation begins. If the winner does not make the room available, sign the
installation agreement, provide the Form W-9, or the installation cannot be completed by the
deadline,
the Grand Prize may be forfeited and awarded to an alternate winner.
8. Privacy and Sharing Information
Personal information collected in connection with the Sweepstakes will be
used
in accordance with ABMP’s Privacy Policy, available at https://www.abmp.com/privacy-policy. ABMP may
share
the winners’ personal information (including your name, address, phone number, and email
address)
with its official Sweepstakes partners as needed to administer the Sweepstakes and fulfill prizes.
ABMP
will also share the Sweepstakes entrants’ name and email address with Sweepstakes partners
The
Spa Mart, Rebel Massage, and Ruth Werner for their own marketing purposes.
9. Social Media Disclaimer
This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Instagram,
Facebook, Meta Platforms, Inc., or any other social media platform. By entering, you release each
such
platform from all liability in connection with the Sweepstakes.
10. Release and Limitation of Liability
By entering the Sweepstakes, you agree, to the fullest extent permitted by law: (i) to release and
hold
harmless ABMP; its parent company, Professional Assist Corporation; The Spa Mart and Teddy Lester;
all
other prize suppliers; and each of their respective affiliates, officers, directors, employees, and
agents (the “Released Parties”) from any and all liability, loss or damage arising out
of
participating in the Sweepstakes or the awarding, receipt, possession, and/or use or misuse of a
prize,
except to the extent caused by a Released Party’s gross negligence or willful misconduct; (ii)
that under no circumstances will entrant or winner be permitted to obtain awards for, and entrant
hereby
waives all rights to claim, any punitive, indirect, incidental, or consequential damages; and (iii)
that
the Released Parties are not responsible for lost, late, incomplete, or misdirected entries or for
any
technical malfunction affecting the Sweepstakes. Any claim for damage to property or injury to
persons
arising out of the Grand Prize installation will be governed by the installation agreement described
in
Section 7. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some
of
the above may not apply to you.
11. Dispute Resolution and Arbitration
Informal resolution. Before starting arbitration, you and ABMP agree to try to resolve any dispute
informally by sending the other a written notice describing the claim (to ABMP at the address stated
at
the beginning of these Official Rules) and negotiating in good faith for at least thirty (30) days.
Binding arbitration. Any dispute, claim, or controversy arising out of or relating to the
Sweepstakes,
these Official Rules, or any prize that is not resolved informally will be resolved by binding
individual arbitration administered by the American Arbitration Association (“AAA”)
under
its Consumer Arbitration Rules, except that either party may bring an individual claim in small
claims
court if it qualifies. The arbitrator, and not any court, will decide all questions about the scope,
validity, and enforceability of this arbitration agreement, except as stated in the severability
paragraph below. ABMP will pay all AAA filing, administration, and arbitrator fees other than the
portion of the filing fee assigned to consumers under the Consumer Arbitration Rules. The
arbitration
will be conducted virtually, unless the parties agree otherwise. Attorneys’ fees and costs
will be
awarded only as provided by applicable law. The Federal Arbitration Act governs this Section.
Class action and jury waiver. You and ABMP may each bring claims against the other only in an
individual
capacity, and not as a plaintiff or class member in any purported class, collective, or
representative
proceeding. The arbitrator may not consolidate the claims of more than one person. YOU AND ABMP EACH
WAIVE THE RIGHT TO A TRIAL BY JURY.
Mass filings. If twenty-five (25) or more similar demands for arbitration are filed by or with the
assistance of the same law firm or coordinated group, they will be administered in batches of up to
twenty-five (25) demands under the AAA’s applicable rules for mass arbitrations, and the
parties
will cooperate in good faith to resolve them efficiently.
Severability. If the class action waiver is found unenforceable as to any claim, that claim will
proceed
in court, not in arbitration, and will be stayed until the individual arbitration is complete. Any
claim
for public injunctive relief that cannot be waived under applicable law will be decided by a court
after
any arbitration of individual claims.
12. Governing Law
All issues and questions concerning the construction, validity, interpretation and enforceability of
these Official Rules, or the rights and obligations of entrant and ABMP in connection with the
Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of
Colorado,
without regard to conflicts of law principles. Subject to Section 12, all entrants consent to the
jurisdiction and venue of the appropriate state or federal court located in Denver, Colorado, for
any
claim not subject to arbitration and for any action to compel arbitration or enforce an arbitration
award.
13. General Conditions
Sponsor reserves the right, in its sole discretion, to cancel, suspend, or modify the Sweepstakes, or
any
part of it, if fraud, technical failure, or any other factor beyond Sponsor’s reasonable
control
impairs the integrity or proper functioning of the Sweepstakes. In that event, Sponsor may award
prizes
from among eligible entries received before the cancellation, suspension, or modification, as
permitted
by law. Sponsor may disqualify any individual who tampers with the entry process or violates these
Official Rules. If any provision of these Official Rules is held invalid or unenforceable, the
remaining
provisions will remain in full force and effect. Sponsor’s failure to enforce any term is not
a
waiver of that term. If there is any conflict between these Official Rules and any Sweepstakes
advertising or promotional materials, these Official Rules govern.
